These Terms and Conditions ("Terms") govern the use of the ShipPilot platform, website, APIs, mobile applications, and related services operated by Skyline Global ("ShipPilot", "Company", "we", "our", or "us").
By registering, accessing, or using ShipPilot, you agree to be bound by these Terms and Conditions.
1. About ShipPilot
ShipPilot is a technology-enabled courier aggregation platform that facilitates shipment booking, courier selection, tracking, COD reconciliation, shipping automation, and related logistics services through third-party courier partners.
ShipPilot is not a courier company and does not directly transport shipments. All transportation services are performed by independent courier partners.
2. User Registration
By creating an account, you agree that:
- All information submitted is true and accurate.
- You are authorized to operate the business associated with the account.
- You shall maintain the confidentiality of your login credentials.
- You are responsible for all activities performed under your account.
ShipPilot reserves the right to suspend, restrict, or terminate accounts found to be engaged in fraudulent, unlawful, or abusive activities.
3. Shipping Services
ShipPilot enables users to:
- Book domestic and international shipments.
- Compare courier rates.
- Generate shipping labels.
- Track shipments.
- Manage returns and RTO shipments.
- Access COD remittance services.
- Integrate shipping APIs into third-party platforms.
Actual pickup, transportation, delivery, and remittance services are performed by courier partners.
4. Prohibited Shipments
Users shall not ship:
- Narcotics or controlled substances.
- Weapons, ammunition, or explosives.
- Hazardous chemicals.
- Counterfeit goods.
- Illegal products.
- Restricted or prohibited items under Indian law.
- Any product prohibited by the selected courier partner.
ShipPilot may refuse, suspend, cancel, or report such shipments without prior notice.
5. Packaging Responsibility
Users are solely responsible for:
- Proper packaging.
- Product labeling.
- Product declaration.
- Documentation accuracy.
ShipPilot and courier partners shall not be responsible for damages arising from inadequate packaging.
6. Weight Discrepancies
Shipping charges are based on:
- Actual weight.
- Volumetric weight.
- Courier partner audits.
If courier partners identify discrepancies in declared weight or dimensions, additional charges may be applied and automatically deducted from the user's wallet or settlement balance.
7. Wallet & Payments
Users may add funds to their ShipPilot wallet for shipment booking.
The Company reserves the right to:
- Hold funds for disputed transactions.
- Recover outstanding dues.
- Adjust incorrect credits or debits.
Wallet balances are non-transferable and may only be used within the ShipPilot platform.
8. COD Remittance
For Cash on Delivery shipments:
- COD funds are released only after confirmation from courier partners.
- Remittance timelines may vary depending on courier partner policies.
- ShipPilot shall not be liable for delays caused by courier partners, banks, regulatory authorities, or force majeure events.
- Any shipping charges, penalties, returns, disputes, or adjustments may be deducted before settlement.
9. Shipment Loss and Damage
ShipPilot acts solely as a technology intermediary.
In the event of shipment loss or damage:
- Claims shall be processed according to courier partner policies.
- Compensation shall be limited to the amount approved by the courier partner or insurer.
- ShipPilot does not guarantee claim approval.
10. Insurance
Insurance services, where available, are provided through courier partners or third-party insurance providers.
Claim approval remains subject to:
- Verification procedures.
- Documentation requirements.
- Insurance provider terms.
11. Delivery Timelines
Estimated delivery timelines displayed on the platform are indicative only.
ShipPilot shall not be liable for delays resulting from:
- Weather conditions.
- Natural disasters.
- Government actions.
- Transport disruptions.
- Courier operational issues.
- Strikes or force majeure events.
12. API Usage
Users integrating ShipPilot APIs agree that:
- API credentials remain confidential.
- APIs shall not be abused, reverse-engineered, or exploited.
- Excessive or malicious requests may result in suspension.
Skyline Global retains ownership of all APIs and platform infrastructure.
13. Intellectual Property
All trademarks, logos, software, dashboards, APIs, designs, content, and technology associated with ShipPilot remain the exclusive property of Skyline Global.
Users shall not:
- Copy platform content.
- Reverse engineer software.
- Scrape platform data.
- Create derivative products.
14. Limitation of Liability
To the maximum extent permitted under law, Skyline Global and ShipPilot shall not be liable for:
- Indirect damages.
- Loss of profits.
- Business interruption.
- Data loss.
- Delayed deliveries.
- Courier partner failures.
Total liability shall not exceed the amount paid by the user for the affected shipment.
15. Indemnification
Users agree to indemnify and hold harmless Skyline Global, ShipPilot, employees, directors, and affiliates against claims arising from:
- Violation of these Terms.
- Shipment of prohibited goods.
- Misrepresentation of shipment contents.
- Violation of applicable laws.
16. Suspension & Termination
ShipPilot may suspend or terminate accounts without prior notice for:
- Fraudulent activity.
- Excessive disputes.
- Chargebacks.
- Policy violations.
- Illegal activities.
17. Privacy
User data shall be handled in accordance with the ShipPilot Privacy Policy. By using ShipPilot, users consent to the collection, storage, and processing of data required to provide logistics services.
18. Modifications
ShipPilot reserves the right to modify these Terms at any time. Continued use of the platform following such changes constitutes acceptance of the updated Terms.
19. Governing Law
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
